Eh luckily says commercial and really I try not to fly over other people's places just out of respect and desire to not lose my quad on their roof and have to explain the hobby to another person 
seems pretty hard to enforce too though just like most of these laws just something else if they want to throw the book at you because someone wants to ruin your day.

Proving whose drone it is would be a problem. At 400 feet or 130 meters and at speed, it would be like trying o identify a bird flying over. More useless ink on more useless paper.
