H501S Whats wrong with it??

So I just ordered a Hubsan H501S off of Ebay and it was broke out of the box. The seller is giving me the run around and doesnt want to take it back. So I am no stranger to a soldering iron so I just want to fix it myself. I took a video for the company I bought it from showing the issues I am having with the quad.... Can anyone tell what is bad by watching this vid??

Hi mate you do know this is in mode 1 throttle on the right most fly mode 2 throttle and rudder on left stick. I would change mode and recalibrate
If you brought a mode 2 and this is what they sent then it's wrong
 
Yup shouldnt be powering up with the right stick. At idle none of the motors should be increasing power without throttle input from the left stick. Try recalibrating it.And be careful of those props!
